Terms & Conditions

Service agreement governing all horological work performed at Wristwright.

These Terms and Conditions ("Agreement") set out the rights and obligations of clients ("you", "Client") and Wristwright ("we", "us", "Workshop") in relation to watch repair, diagnostic, engraving, refinishing, and storage preparation services provided from our premises at 56 Jalan Macalister, 10400 George Town, Penang, Malaysia. Reading this Agreement before entrusting any timepiece to Wristwright is your responsibility. Submitting a timepiece for assessment or service constitutes acceptance of these terms.

1. Definitions

"Service"
Any horological work commissioned by the Client, including movement diagnostics, written condition reports, caseback engraving, case refinishing, and long-term storage preparation.
"Timepiece"
Any watch, clock, or similar instrument surrendered by the Client to Wristwright for the purpose of assessment or service.
"Report"
The written movement diagnostic document issued by Wristwright following a complete assessment of a Timepiece.
"Intake Form"
The written record completed at reception documenting the Timepiece's condition and visible defects prior to commencement of work.
"Agreement"
These Terms and Conditions, together with any written service quotation or intake form signed by the Client.

2. Acceptance of Terms

By presenting a Timepiece to Wristwright for any service, you confirm that:

  • You are the legal owner of the Timepiece, or you hold written authority from the owner to commission the requested work.
  • You are aged 18 or above, or are accompanied by a legal guardian who accepts these terms on your behalf.
  • You have read and understood this Agreement in full.
  • You have the legal capacity to enter a binding agreement under Malaysian law.

Accepting a written quotation or signing an Intake Form also constitutes acceptance of all provisions herein.

3. Service Description

Wristwright offers specialist horological services from our workshop at 56 Jalan Macalister, George Town, Penang. Current service offerings include:

Service A
Movement Diagnostic and Written Report — RM 360

Complete inspection of movement condition, lubrication state, amplitude, beat error, and rate deviation. Delivered as a written report with photographic documentation.

Service B
Caseback Engraving and Refinishing — RM 540

Hand engraving of text, monograms, or motifs to the caseback, combined with case surface cleaning and targeted refinishing of worn areas.

Service C
Long-Term Storage Preparation — RM 720

Preparation for extended storage including movement inspection, mainspring relief, case sealing assessment, humidity-controlled packaging, and a written storage log.

Wristwright reserves the right to decline any commission that falls outside our documented competencies or that poses undue risk to the Timepiece.

4. Intake & Assessment

All Timepieces are received in person at our workshop during operating hours: Monday to Friday 10:00–18:00, Saturday 10:00–14:00. We do not accept postal or courier submissions.

At intake, a member of our team will:

  • Record the Timepiece's visible condition on the Intake Form, noting any pre-existing scratches, dents, missing components, or damage.
  • Photograph the Timepiece for workshop records.
  • Issue a receipt bearing the Timepiece description, service requested, and estimated collection date.

Signing the Intake Form confirms agreement with the pre-service condition record. Disputes regarding pre-existing damage raised after signing cannot be upheld.

For complex commissions, we may request a preliminary assessment period before providing a final quotation. Where the final cost differs from any initial estimate by more than 15%, we will contact the Client before proceeding.

5. Client Responsibilities

As a Client of Wristwright, you agree to:

  • Provide accurate information about the Timepiece's history, any prior repair work, and known defects.
  • Disclose if the Timepiece has been modified from its original factory specification.
  • Collect the Timepiece within 14 calendar days of notification that work is complete.
  • Settle all outstanding fees at the time of collection.
  • Not misrepresent ownership or title of any Timepiece submitted to Wristwright.

Uncollected Timepieces: If a Timepiece is not collected within 90 calendar days of completion notification, Wristwright reserves the right to apply a storage surcharge of RM 5 per day from day 15 onwards. After 180 days without collection or contact, Wristwright may treat the Timepiece as abandoned and exercise disposal rights under applicable Malaysian law.

6. Payment Terms

All prices are quoted and payable in Malaysian Ringgit (RM). Published prices are inclusive of applicable Malaysian tax at the prevailing rate.

Payment methods accepted: Cash, DuitNow QR, and major local bank transfers. We do not accept cryptocurrency.

Deposit: For commissions valued at RM 500 or above, a 30% deposit may be requested at intake. The deposit is non-refundable if the Client cancels after work has commenced.

Balance: The remaining balance is due in full at the time of Timepiece collection. No Timepiece will be released until all fees are settled.

Price variations: Where additional defects discovered during service materially affect scope or cost, we will contact the Client for approval before proceeding.

Post-collection: Once the Client has collected a Timepiece and signed the collection record, the transaction is considered complete. Concerns must be raised before leaving the premises.

7. Turnaround Times

Estimated turnaround periods are provided at intake as a guide only and are not contractual commitments.

Delays may arise from the need to source specialist parts, unexpected movement complexity, or workshop capacity. We will communicate any significant delay promptly. Wristwright accepts no liability for loss arising from a service taking longer than the estimate.

8. Intellectual Property

All written Reports, documentation, engraving design sketches, and workshop records produced by Wristwright remain the intellectual property of Wristwright unless otherwise agreed in writing.

The physical Report document issued to the Client is licensed for personal reference only. It may not be reproduced, published, or used commercially without our prior written consent.

Engraving designs commissioned and approved by the Client become the property of the Client upon full payment. Wristwright retains the right to reference the commission in its portfolio unless the Client requests otherwise at intake.

9. Disclaimers

Services are provided with reasonable professional care. However, the following limitations apply:

  • No outcome assurance: Horological work involves aged mechanical components. We cannot assure that a service will resolve every issue or restore a Timepiece to factory specification.
  • Pre-existing damage: We are not responsible for pre-existing internal damage that becomes apparent during legitimate service work.
  • Parts availability: We cannot always source original manufacturer parts. We will inform the Client if period-correct or generic equivalent parts are required, and seek written approval before proceeding.
  • Valuation: No service provided by Wristwright constitutes a formal appraisal or valuation for insurance, sale, or legal purposes.
  • Water resistance: Unless specifically tested and documented as part of the service scope, any manufacturer water-resistance claim should be independently re-confirmed after work is completed.

10. Limitation of Liability

To the extent permitted by Malaysian law, Wristwright's total liability to any Client in connection with any single Timepiece shall not exceed the total fees paid for the relevant service.

Wristwright shall not be liable for:

  • Indirect, consequential, or special losses, including loss of investment value or sentimental loss.
  • Loss or damage to a Timepiece caused by circumstances outside our reasonable control, including fire, flood, theft, or other force majeure events.
  • Damage arising from the Client's failure to disclose material information about the Timepiece's prior condition or modifications.

Nothing in this Agreement excludes or limits liability for death or personal injury caused by Wristwright's negligence, or for fraud or fraudulent misrepresentation.

11. Indemnification

The Client agrees to indemnify and hold harmless Wristwright, its staff, and associates from any claim, loss, or expense arising from:

  • The Client's misrepresentation of ownership or title to a Timepiece.
  • Wilful withholding of material information that directly contributes to service complications.
  • Third-party claims arising from services commissioned by the Client where the Client lacked proper authority.

12. Termination

Client cancellation: The Client may cancel a service commission at any time by contacting Wristwright in writing. Where work has already commenced, the Client will be invoiced for reasonable costs incurred to the cancellation date. The Timepiece will be returned upon payment of this amount.

Wristwright's right to decline: We reserve the right to decline or cease a commission at our discretion. Where we initiate cessation without cause attributable to the Client, no charges will apply for work in progress, and the Timepiece will be returned promptly.

Survival of clauses: Provisions relating to payment, limitation of liability, intellectual property, and indemnification shall survive any termination of this Agreement.

13. Dispute Resolution

Governing law: This Agreement is governed by the laws of Malaysia. The courts of Penang shall have jurisdiction over any dispute arising from this Agreement.

Informal resolution: All disputes should first be directed to Wristwright in writing at [email protected]. We will respond within 10 working days and endeavour to reach a mutually acceptable resolution.

Mediation: If informal resolution fails, both parties agree to attempt mediation through the Malaysian Mediation Centre before initiating legal proceedings.

Consumer rights: Nothing in this Agreement removes any statutory rights available to Clients under the Consumer Protection Act 1999 (Malaysia) or applicable subsidiary legislation.

14. General Provisions

Entire agreement: This Agreement, together with any signed Intake Form or written quotation, constitutes the entire agreement between Wristwright and the Client regarding the relevant commission.

Severability: If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Failure by Wristwright to enforce any provision shall not constitute a waiver of the right to enforce that provision subsequently.

Assignment: The Client may not assign or transfer any rights under this Agreement without Wristwright's prior written consent.

Language: This Agreement is written in English. In the event of any translation, the English version shall prevail.

15. Changes to These Terms

Wristwright may update these Terms and Conditions from time to time. The current version will always be available on our website at the address indicated in the "Last Updated" field above.

Commissions accepted before a revision date remain subject to the terms in force at the time of intake, unless the Client agrees otherwise in writing.
